The High Court of Calcutta ruled that interest on rent cannot be considered as rent under the Bengal Tenancy Act. A suit for recovery of interest only, without a claim for rent, is not maintainable. The Court dismissed the appeal and allowed the revision application, setting aside the decisions of the lower courts and dismissing the plaintiff's suit. Each party is to bear their own costs.
