2019 (2) TMI 1967 - HC - Money Laundering

Issues:
1. Conversion of arrest warrants to bailable warrants in a complaint case under the Prevention of Money Laundering Act, 2002.

Analysis:
The judgment pertains to a petition filed under Section 482 Cr.P.C. seeking to set aside an order passed by the Special Sessions Court, Jaipur, which had summoned the petitioner through arrest warrants for offenses under Sections 3 and 4 of the Prevention of Money Laundering Act, 2002. The petitioner's counsel argued that the arrest warrants should be converted to bailable warrants, citing the case of Inder Mohan Goswami & Another Vs. State of Uttaranchal. The High Court considered the arguments presented and decided to convert the arrest warrants against the petitioner to bailable warrants based on the judgment referred to by the petitioner's counsel.

The petitioner's counsel contended that in a complaint case, the petitioner should not have been summoned through arrest warrants initially. After hearing both the petitioner's counsel and the Public Prosecutor representing the State, the High Court, in light of the judgment cited, ordered the conversion of the arrest warrants to bailable warrants. Consequently, the High Court disposed of the petition in favor of the petitioner, granting the relief sought regarding the conversion of the arrest warrants.

Furthermore, the counsel for the petitioner requested that the present petition be disposed of in the same terms as in the order dated 17.12.2018 passed in another case, Pushpendra Agarwal vs Mukesh Kumar Meena. The High Court granted the prayer, disposing of the present petition in the same terms as the mentioned case, thereby providing consistency in the application of the legal principles and relief granted in similar cases.
