Adjudicating authority in the impugned order denied credit and confirmed the demand and appropriated the amount which is already paid by the applicant appellant s submission is that they had already re-credited the amount suo motu prior to adjudication order - as the amount paid is appropriated in the impugned order, we direct the applicant to reverse the credit immediately. On reversal of credit the pre-deposit of penalties are waived
