2019 (11) TMI 1275 - HC - Central Excise

Issues:
Withdrawal of petition under "Sabka Vishwas (Legacy Dispute Resolution) Scheme, 2019"

Analysis:
The High Court of Gujarat, comprising Honourable Ms. Justice Harsha Devani and Honourable Ms. Justice Sangeeta K. Vishen, heard a matter where the petitioners, represented by Mr. Paresh Dave, sought to withdraw their petition. The petitioners had filed a declaration under the "Sabka Vishwas (Legacy Dispute Resolution) Scheme, 2019," which was accepted by the Committee under the Scheme. The Committee's acceptance was conditional upon the withdrawal of the writ petition, requiring the petitioners to produce the order of withdrawal before the Committee. Consequently, the petitioners instructed their advocate to withdraw the petition. Mr. Paresh Dave, the learned advocate, informed the court about the petitioners' decision to withdraw and sought permission for the same. The court, presided over by Honourable Ms. Justice Harsha Devani, granted the permission to withdraw the petition. Subsequently, the petition was disposed of as withdrawn, and notice was discharged with no order as to costs.

This judgment primarily dealt with the issue of withdrawal of a petition under the "Sabka Vishwas (Legacy Dispute Resolution) Scheme, 2019." The petitioners had filed a declaration under the said scheme, which was accepted by the Committee subject to the condition that the writ petition be withdrawn. The court, upon being informed by the petitioners' advocate about their decision to withdraw the petition, granted permission for the withdrawal. The court's decision to allow the withdrawal was in line with the Committee's requirement for the petitioners to produce the order of withdrawal before them. Consequently, the petition was disposed of as withdrawn, and no costs were imposed.
