2017 (11) TMI 2064 - HC - Indian LawsSuit for recovery together with pendente lite and future interest - prayer for discharge of its bank guarantees - Section 8 of the Arbitration and Conciliation Act 1996 - HELD THAT - The plaintiff states that he has no objection to the matter being referred to the Arbitration provided the Court-fees paid in the present suit is refunded. Consequently with consent of parties this Court refers the parties to the Arbitration. Accordingly present suit stands disposed of.
The High Court of Delhi referred a recovery suit to arbitration under Section 8 of the Arbitration and Conciliation Act, 1996 due to the presence of an arbitration clause in the contract. The plaintiff agreed to arbitration on the condition that court fees paid would be refunded. The suit was disposed of with parties' consent, and the plaintiff was directed to receive a refund of court fees from the Collector.
