2018 (10) TMI 2046 - HC - Law of Competition


**Summary:** In the case before the Delhi High Court, presided over by Hon'ble Mr. Justice Vibhu Bakhru, the legal representatives for both the petitioner and the respondents acknowledged that the issue at hand was addressed by a prior decision of the Division Bench in "Cadila Health Care Limited v. Competition Commission of India & Ors, LPA No. 160/2018" decided on 12.09.2018. The petitioner, represented by Mr. P.V. Kapoor, argued that this decision was erroneous and sought a stay on the impugned order for fifteen days to appeal to the Division Bench. However, this request was contested by Mr. Jayant Bhushan, representing the respondents. The court noted that the interim order from 15.05.2017 only clarified that any action under Section 43 of the Competition Act, 2002, would be subject to further court orders. Consequently, the court found it inappropriate to grant the stay requested by the petitioner. The petitions and all pending applications were dismissed, and the order was directed to be issued under the signature of the Court Master.
