Summary

The Appellate Tribunal CEGAT, New Delhi granted waiver of pre-deposit for hearing of the appeal due to financial hardship of the petitioners whose unit was declared sick. The petitioners were required to give an undertaking not to alienate fixed assets during the appeal. The appeal would be heard in due course. The issue of modvat credit based on certified copy of bill of entry was arguable and needed further examination. The Department opposed the plea for stay, citing risk of multiple availment of credit and withdrawal of earlier procedure for loss of duty paying documents.
