Rule 2 - Qualification for recruitment - Appellate Tribunal For Foreign Exchange (Recruitment, Salary & Allowances & Other Conditions of Service Of Chairperson & Members) Rules, 2000

Qualification for recruitment. 2. (1) A person shall not be qualified for appointment as Chairperson or a Member unless he : (a) in the case of a Chairperson, is or has been or is qualified to be a Judge of a High Court; and (b) in the case of a Member, is or has been or is qualified to be a District Judge. (2) No person— (a) who has entered into or contracted a marriage with a person having a spouse living; or (b) who having a spouse living has entered into or contracted a marriage with any person shall be eligible for appointment as the Chairperson or a Member : Provided that the Central Government, if satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and there are other grounds for so doing, exempt any person from the operation of this rule.
