Withholding of refund u/s 241 - Income Tax - 532/CBDT

INSTRUCTION NO. 532/CBDT Dated : March 27, 1973 Section(s) Referred: 241 Statute: Income - Tax Act, 1961 The Board has recently noticed some cases where refunds are delayed because the case records are with the higher authorities in connection with departmental appeals. Unless it is necessary to withhold the refund u/s 241 ordinarily effect should be given to the appellate order and refund issued before sending the case up for consideration of a departmental appeal. This may be brought to the notice of all the Income-tax officers working in your charge.
