Assessment of directors and senior executives of companies - jurisdiction - Income Tax - 566/CBDT

INSTRUCTION NO. 566/CBDT Dated : July 5, 1973 Section(s) Referred: 127 Statute: Income - Tax Act, 1961 I am directed to refer to the decision arrived at the Commissioner conference, 1973 to assign the cases of the directors and senior executives of important companies to the Income-tax Officers having jurisdiction ever the cases of companies. Where it is not possible to implement the recommendation wholly, the cases of directors and senior executives to the Income-tax Officers having jurisdiction ever the companies by rotation each year (vide para 3 of the minutes of the Commissioners Conference, 1973). 2. Board desires that the recommendation of the Commissioners Conference must be implemented immediately. If the cases of the directors and the senior executives are assessed within the jurisdiction of the Commissioner having jurisdiction ever the companies Circle, then such cases can be transferred by the Commissioner u/s 127. However, if the cases of the directors and the senior executives and these of companies fall within the jurisdiction of the different Commissioners, proposals u/s 127 to assign the cases of the directors and senior executives to the I.T.O. having jurisdiction ever the company cases may please be forwarded to Board by 31st July, 1973 positively.
