Maintenance of statistics relating to penalty proceedings - Income Tax - 585/CBDTExtract INSTRUCTION NO. 585/CBDT Dated : August 13, 1973 In their 87th Report presented to the Lok Sabha recently, the P.A.C. have observed that the maintenance of statistics relating to penalty proceedings should be improved so as to bring out the information relating to pendency of penalty proceedings at any given point of time as also to keep a control over the number of such proceedings which had got time-barred for non-finalisation of proceedings within the prescribed time. 2. Attention in this connection is invited to para 8 of Board's circular No.25-D of 1963 dated 1.10.1963 prescribing a register for penalties to be maintained by the I.T.Os. There should be no difficulty in preparing necessary statistics for the purpose indicated above from the various columns of this register if the register is maintained properly. In order to ensure that this register is maintained properly, it has been decided that in future the I.T.O. should record in the relevant order sheet both at the time of initiation and completion of penalty proceedings that necessary entries have been made in the Register of penalties. The relevant serial number and the page number of the Register of penalties should also be recorded in the order sheet. 3. It has also been decided that the Commissioners should watch and review the progress of penalty proceedings through quarterly reports prescribed by them. A half-yearly report indicating the position of penalties initiated, completed and pending as on 30th September and 31st March, every year should be sent to the Board on the 31st October and on the 30th of April every year. 4. The first half-yearly report should reach the Board by the 31st of October, 1973.
