Import of hazardous waste - Customs - 17/2011Extract OFFICE OF COMMISSIONER OF CUSTOMS CUSTOMS HOUSE: COCHIN -682009 TRADE FACILITY 17/2011 F.No. C1/08/2011TU Cus. Date: 28.09.2011 Attention of all the Importers/CHAs and members of the Trade is invited towards CBEC s Circular No. 27/2011 Cus dated 04.07.2011 regarding Import of hazardous waste under Hazardous Waste (Management, Handling and Transboundary) Rules, 2008 The Board, vide its letter, F.No. 401/130/2011-Cus III dated 17.08.2011 has clarified that the import of secondhand photocopiers are also covered under Hazardous Waste (Management, Handling and Transboundary) Rules, 2008. Vide above mentioned Circular the Board has issued the following instructions regarding import of e-waste, interalia, used computers, Electronic and electric sub assemblies. In this regard, the CEBC has consulted Ministry of Environment and Forests and they have confirmed that items at A1180 of the said Schedule III relating to waste electrical and electronic assemblies or scrap containing components such as accumulators and other batteries etc. require Prior Informed Consent. It is also confirmed that items at B1110 of the said Schedule III can be imported with permission from Ministry of Environment and forests. This entry includes electrical and electronic assemblies (including printed circuit board electronic components and wires) destined for direct re-use and not for recycling or final disposal. It should be noted that all imported goods falling within the purview of entry B 1110 of Part B of Schedule III of the said Rules, would require the permission of the Ministry of Environment and Forests for import into India. As per Rule 17 of the said Rules, contravening imports will be treated as illegal traffic requiring the importer to re-export the wastes at his cost within 90 days from the date of arrival. In the light of the above all importers of the above goods shall produce Prior Informed Consent in clearance from the MoEF at the time of arrival in India failing which the goods shall be re-exported in terms of the rule 17 stated above.
