Cus. Date : . 23-01-2013 Sub: Custom House Agents Licensing Regulations, 2004 - Invitation of applications for grant of New CHA licences Reg. Applications are invited for grant of new Customs House Agent licences in terms of Regulation 4 of Customs House Agents Licensing Regulations, 2004 by this Commissionerate. 2. In terms of the provisions contained therein fresh applications shall be made in the form of letter to the Commissioner of Customs, Cochin containing details as specified in Form A (enclosed) and shall, inter alia contain the name and the address of the person applying and i) if the applicant is a firm:- a) the name and address of every partner of the firm, the firm s name and b) the name of the partner or duly authorized employee, who will actually be engaged in the clearance of goods or conveyances through the Customs. ii) if the applicant is a company:- a) the name and address of each Director, Managing Director, Manager and b) the names of Director, Managing Director or the duly authorized employee who will actually be engaged in the clearance of goods or conveyance through the Customs. 3. The applicant referred to in clause (b) of para 2(i) and 2 (ii) above, as the case may be shall be a person who has passed the examination referred to in Regulation 8 of CHALR, 2004 at Cochin Custom House and shall prove to the satisfaction of the Commissioner of Customs, Cochin that:- a- (i) the applicant, or his authorized employee, is a Graduate from a recognized University and possesses a professional degree viz C.A/M.B.A/L.L.B/Diploma in Customs Clearance work from any Institute or University recognized by the Government with a working knowledge of computers and customs procedures. (OR) (ii) Is a graduate having at least three years experience in transacting Custom House Agent work as G card holder. (OR) (iii) a person who passed the examination referred to in Regulation 8. (OR) (iv) is a retired Group A Officer from the Indian Customs and Central Excise Service (IC CES) having a minimum of ten years experience in Group A. b) The applicant has financial viability supported by a certificate issued by a Scheduled Bank or other proof issued by the State Revenue Authority acceptable to the Commissioner of Customs evidencing possession of assets of value of not less than ₹ 2 lakhs. c) The applicant is a citizen of India. 4. The applicants who qualify for grant of a licence under Regulation 9 (1) of CHALR, 2004 shall be required to submit the following before the licence is actually granted. i) A bond in Form -D and a surety bond in Form E for due observance of these regulations as per Regulation 10 of CHALR, 2004. ii) A bank guarantee, postal security or National Savings Certificate in the name of the Commissioner of Customs for an amount of ₹ 75,000/- for carrying out of business as a Customs House Agent as per Regulation 10 of CHALR, 2004. iii) CHA Licence fee of ₹ 5,000/- paid in TR-6 Challan as per Regulation 9 of CHALR, 2004. 5. The applicant shall also submit Bio-Data in respect of the Proprietor/all the Partners/Directors and nominated Regulation qualified candidate, showing complete details of service for the past twenty years (as applicable) including the services as/in Customs House Agents, if any. 6. The applicant should also declare separately whether they are presently holding any CHA licence at Cochin/elsewhere. If so, full details of the same should be furnished separately along with the application. If not, a specific declaration to this effect should be given separately. Particulars of holding any CHA licence in the past and reasons for discontinuing of the same, if any, should also be mentioned. 7. The applicant (and their Partners/Directors etc.) should also declare that they are/were not involved in any case booked against them under the Customs Act, 1962/Allied Acts anywhere in India for the last 20 years. If so, full details and final outcome of such case(s) should be furnished. 8. The last date of receipt of application is 31.03.2013. 9. The application for grant of Custom House Agents licence is invited in accordance and in terms of Board s instructions contained in Board s letter F.No.502/5/2005-Cus VI dated 31.10.2007 and F.No.502/5/2008-Cus VI dated 08.04.2010. 10. Application received prior to the issuance of this Notice or the application received after 31.03.2013 shall not be considered. Any applicant whose application is received within the last date specified in the notice of publication and who satisfies the requirements as in para 3 (a) (i), (ii) (iv) shall be required to appear for the written as well as oral examination conducted by the Director General of Inspection at specified center and specified dates for which intimation shall be sent individually in advance before the date of examination. 11. The applicants should fulfill the conditions stipulated in the aforesaid Regulations. The applicants should ensure their eligibility before applying for such licence and in the absence of the same their applications will be summarily rejected. 12. In the matter of considering applications received and grant of Custom House Agents License at Cochin Custom House, the Licensing Authority viz., the Commissioner of Customs reserves the right to reject any application found incomplete in any respect or otherwise without assigning any reason. 13 . In case the applicant is a firm or a company, the : name(s) of its partner/partners or director/directors or duly authorized employees who will actually be engaged in the work as Custom House Agents 4. In case it is desired to appoint clerk(s), the : name and address of the clerk(s) 5. Educational qualification of each of the persons, : who will actually be engaged in the work as Custom House Agent (including proof of working knowledge of computers) 6. Particulars regarding knowledge of English, : local language and Hindi (these particulars are required in respect of each of the persons actually engage in the work as Custom House Agent) 7. Particulars regarding knowledge of Customs : Law and procedure. (these particulars are required in respect of each of the persons actually engage in the work as Custom House Agent) 8. Whether the applicant had earlier applied for a : licence to act as Custom House Agent and whether such application was rejected 9. Whether he or the firm or company by whom he : is employed have earlier held a Custom House Agent s Licence under these Regulations and whether it was cancelled or suspended 10. Whether the applicant or any of the persons : proposed to be employed by him have been penalized, convicted or prosecuted under any of the provisions of the Customs Act, 1962 (52 of 1962) or any other law for the time being in force 11. Number and date of each of the documents : furnished in accordance with Regulation 5 I/We hereby affirm that I/We have read the Custom House Agent s Licencing Regulations, 2004 and agree to abide by them.
