No. S/5-Gen-32/2016-17 CFS M Cell Dated: 05.12.2016 Public Notice No. 168/2016 Sub: Computation and publishing of average dwell time by CFS on their website and communication to Customs, instruction issued under Handling of Cargo in Customs Areas Regulations, 2009 : reg. Attention of the Container Freight Stations (CFSs) falling in the jurisdiction of JNCH is invited to the Handling of Cargo in Customs Areas Regulations, 2009 (hereinafter referred to as HCCAR, 2009 ) as amended by Notification No. 96/2010 dated 12.11.2010. 2. Clause (n) of Regulation 5 (1) of HCCAR, 2009 provides that Customs Cargo Service provider shall provide such other facilities as the Commissioner of Customs may specify having regard to the custody and handling of imported or export goods in a customs area; 3. Sub Regulation (4) of Regulation 5 of HCCAR, 2009 provides that the Customs Cargo Services provider is bound to comply with the provisions and abide by all the provisions of the Act and the rules, regulations, notifications and orders issued thereunder. 4. As per Regulation 6 (1) (q) of the HCCAR, 2009, a CCSP will abide by all the provisions of the Act and the rules, regulations, notifications and orders issued 5. In order to increase ease of doing business, reduce dwell time and bring transparency in the functioning of CFSs, following directions are issued in terms of Clause (n) of Regulation 5(1), Sub Regulation (4) of Regulation 5 and Regulation 6(1)(q) of Handling of Cargo in Customs Areas Regulations, 2009 : i. Compute and publish on their website cargo dwell time (separately for export cargo and import cargo) on monthly basis in the format as mentioned at Para 7 below; ii. Export dwell time should reflect average of the difference between gate in time and gate out time in respect of export cargo cleared from CFS for export during the month in respect of normal clearances; iii. Similarly, import dwell time should reflect average of the difference between gate in time and gate out time in respect of imported cargo cleared from CFS for home consumption or warehousing during the month in respect of normal clearances; iv. Dwell time needs to be updated on CFS website on monthly basis; v. The same also needs to be communicated to Customs by 5th day of succeeding month so that the same will also be displayed on JNCH website by 10th of the said month. vi. In case, any CFS does not communicate the said information to Customs by due date, the same will be mentioned on the JNCH website as Not Submitted . 6. It is also decided that CFS achieving least average dwell time for export cargo and import cargo will be prominently declared on JNCH website every month and Certificate of Recognition will also be awarded. This benchmarking through transparent process will increase healthy competiveness among CFSs and will also indicate operational efficiency of CFSs in handling imported and export cargo. 7. The format for such report (along with and one sample entry for reference) should be under: Name of CFS Month Nos of Import clearances Average Import Dwell time for the month (in Hours) Nos of Export clearances Average Export Dwell time for the month (in Hours) XYZ* December 16 1500 13.36 hours 700 7.58 ours * Sample data , for reference only. ** CFSs should also provide details of those consignments where goods have not been cleared by importer even after 24 hours of issue of Out of Charge (OOC) by Customs. The said information should be provided to Customs through email on monthly basis. 8. Any non-compliance by any CFS should be brought to the knowledge of ADC/JC (PG), who will ensure that suitable action is initiated against the defaulter. 9.
