PUBLIC NOTICE NO. 13/2017 Sub: Written examination under Regulation 6 of the Customs Broker Licensing Regulations (CBLR), 2013, for grant of Customs Broker License to be conducted on 19.01.2018 Attention is invited to the communication received from the Directorate General of Performance Management, Customs and Goods and Service Tax, New Delhi (Annexure I) for the Customs Brokers Licence Written Examination. It is hereby notified to all that the written examination under Regulation 6 of the Customs Broker Licensing Regulations (CBLR), 2013 which is a pre-requisite for the grant of Customs Broker Licence, will be conducted on 19.01.2018 by this Commissionerate. 2. Regulation 5 of CBLR, 2013 prescribes the conditions to be fulfilled by the applicants for the examination, as mentioned below: The applicant for a licence to act as a Customs Broker in a Customs Station shall prove to the satisfaction of the Commissioner of Customs, that:- (a) he is a citizen of India; (b) he is a person of sound mind; (c) he is not adjudicated as insolvent; (d) he has neither been convicted by a competent court for an offence nor any criminal proceeding is pending against him in any court of law; and (e) he has not been penalised for any offence under the Act, the Central Excise Act, 1944 and the Finance Act, 1994. (f) an individual applicant or in case the applicant is a firm or company its partner or director or an authorised employee who may handle the Customs work shall: (i) be a graduate from a recognised University, and (ii) possess a professional degree such as Masters or equivalent degree in Accounting, Finance or Management, CA/ MBA/ LLB/ACMA/FCMA or Diploma in Customs Clearance work from any Institutes or University recognised by the Government or is having at least two years experience in transacting Customs Broker work as G-Card holder; (g) he is a retired Group 'A' officer from the Indian Customs and Central Excise Services having a minimum of five years experience in Group 'A' service; (h) the applicant has financial viability as evidenced by a certificate issued by a Scheduled Bank or such other proof acceptable to the Commissioner of Customs in terms of possession of assets of value of not less than five lakhs rupees: Provided that for the purpose of his satisfaction, the Commissioner of Customs may make enquiries as may be deemed fit. 3. The Customs Broker Licence holders granted permission to operate under Regulations 13(2) or 14(2) of CBLR, 2013, may also apply or nominate their Employees / Directors / Partners possessing the above cited qualifications to appear for the said written examination. 4. Candidates have the option to answer either in Hindi or English. The date of the written examination shall not be changed even if it is declared a holiday. The syllabus of the examination is given in Regulation 6 of CBLR, 2013. The CBEC website (www.cbec.gov.in) or DGICCE website (www.dgicce.nic.in) may be referred to for any additional information. 5. As per the Regulations, the candidate who has successfully passed the written examination shall be called for an oral exam. A candidate needs to pass both the Written and Oral examination to qualify for the issue of Customs Broker (CB) Licence. An applicant who fails to clear the oral examination within 2(two) years from the date of declaration of the result of the related Written Examination, shall be treated as having failed in the examination. 6. An applicant is allowed a maximum period of 7(seven) years from the date of original application within which he shall pass both written and oral examinations and no further extensions shall be granted as per the provisions of Regulation 6 (6) of CBLR, 2013. 7. The information regarding the final list of candidates found eligible to appear in the written examination, their Roll Numbers, seating arrangements, etc., will be published in the website of the Cochin Custom House (www.cochincustoms.nic.in) as well as on the Notice Boards of the Custom House. 8. The applications for the examination complete in all respect should be submitted in person or by Registered Post / Speed Post in Form-A given at Annexure-II along with two passport size photos, self attested documents on citizenship (Aadhaar/Passport/Voter Card), educational qualification and financial viability and other requirement. One passport size photo must be pasted on Form 'A' and should be attested by a Gazetted Officer. The list of the documents required is provided at Annexure III. In case the declarations made and/or documents furnished are found to be incorrect / incomplete, the application is liable to be rejected and / or the Customs Broker licence is liable to be cancelled. 9. The complete application for the examination should reach the Deputy Commissioner of Customs (Import and Bonds), Office of the Commissioner of Customs, Custom house, Willingdon Island, Cochin-682 009 from 16 October 2017 to 17 November 2017 up to 06.00 PM. Incomplete applications, applications received prior to the issue of the notice by DGICCE and applications received after 17 th November 2017, 06.00 PM shall not be entertained under any circumstances. 10. Applicants are advised to ensure the completeness of the application before its submission. No deficiency memo will be issued to the applicants regarding incomplete applications and such applications will be summarily rejected. No correspondence in this regard shall be entertained by this office. 11. As CBLR, 2013 does not provide for any 'provisional candidature', no candidate will be allowed to appear in the examination on provisional basis. 12. The syllabus of the written examination will be as per Regulation 6(7) of CBLR, 2013. 13.
