No. 95/11/93-CX.3] Government of India Ministry of Finance (Department of Revenue) Central Board of Excise Customs, New Delhi Subject : Central Excise - Classification of Copper Phthalo Cyanine Crude (CPC Blue) falling under Chapter Heading No. 3204.19 - Clarification regarding. Kind attention is invited to Board's Circular No. 2/93- CX.3 (F. No. 95/8/92-CX.3), dated 21-5-1993 wherein it was clarified that Copper Phthalo Cyanine pigment of purity 95% (+1% subject to moisture content) and the most of which passes through the sieve also of 100-125 mm may be considered to be standardised ready to use form. On the basis of die aforesaid Circular No. 2/93-CX.3, dated 21-5-1993 and Chief Chemist's opinion, Trade Notices have been issued by field formations. 2. Now, representations have been received from the Trade that the wordings of last para of Chief Chemist's opinion might penalise the products of higher purity (over and above 96%) and thus do unintended harm to the Industry. It has accordingly been requested that the last para of Chief Chemist's opinion may be suitably amended to the effect that a pigment of purity not less that 94% will qualify to be treated as standardised ready to use pigment. 3. The matter has been re-examined in consultation with the Chief Chemist, CRCL, New Delhi. On the basis of re-considered opinion of the Chief Chemist CRCL, the Board hereby clarifies that Copper Phthalo Cyanine pigment of purity not less than 95% on dry basis and the most of which passes through the seive of 100-125 mm may be considered to be standardised ready to use form. The earlier clarification contained in Board's Circular No. 2/93-CX.3, dated 21-5-1993 ibid may be treated to have been amended to this extent. 4. All pending assessments may be finalised on the above basis subject to testing of samples in each case. Lower field formations may be advised suitably. The trade may also be informed accordingly. 5.
