No. S40(EDI)-45/2017 Dated: 21.06.2019 Public Notice No. 47/2019 Subject: Implementation of Export Transhipment (ET P) Module for movement of export cargo from Kolkata Port to Gateway Port in ICES - clarification. Attention of Exporters / Customs Brokers / MLOs / Steamer Agents / Feeder Operators and Trade, is brought to the Public Notice No. 10/2019 dated 30.01.2019 issued by the Commissionerate of Customs (Port), Kolkata on the matter related to Transhipment of export consignments from Kolkata / Haldia Port / CFSs to the Gateway Ports in the EDI System and difficulties being faced in implementing the same. 1. With reference to Para 2.2 of the Public Notice No. 10/2019 dated 30.01.2019 it is hereby clarified that the Continuity Bond shall be submitted and registered in ICES as Transhipment (T P) Bond by the respective Main Line Operator (MLO) or the Carrier / Custodian authorized by the concerned MLO and there shall be no deviation or ambiguity on this issue. 2. With reference to Para 2.6 Para 2.7 of the Public Notice No. 10/2019 dated 30.01.2019, it shall be the responsibility of the Main Line Operator (MLO) or the Carrier / Custodian authorized by the concerned MLO to produce a copy of the Transhipment Permit before the Customs Officer (Appraiser / Superintendent) posted at the Gateway Port, designated for approving Allowed for Shipment in the ICES and ensure that the approval for shipment is given in the ICES, subsequent to which bond debited during the ETP approval shall be re-credited in the ICES System. 3. In case of shipments from the SEZ against manual Shipping Bills where LEO has been given by the concerned SEZ Officer, and other manual Shipping Bills filed under provisions of Customs Act, 1962 with the approval / permission of the Commissioner of Customs (Port), the Main Line Operator (MLO) or the Carrier / Custodian authorized by the concerned MLO shall produce a separate Continuity Bond, which shall be separately registered at the Import Noting Section of the Custom House, Kolkata or the Mini Custom House, Haldia and thereafter submitted at the Customs Office of the Terminals / Docks (Kolkata / Haldia). The concerned Customs Officer posted at the Terminals / Docks (Kolkata / Haldia) will maintain the said Continuity Bond and the bond amount shall be manually debited by the said Customs Officer from the Bond executed, as soon as Manual ET P approval / permit is given in respect of the said consignment. 3.1 It is clarified that the Bond Amount in respect of manual ETP issued against Manual Shipping Bills, shall be debited from the aforesaid Continuity Bonds only in respect of Manual Shipping Bills so filed. This would have no bearing on the other Continuity Bonds submitted in respect of ICES Shipping Bills for Export Transhipments where the procedure shall be followed as prescribed in the Public Notice No. 10/2019 dated 30.01.2019 and thus Bonds registered in the ICES shall be used only in respect of EDI Shipping Bills and electronically generated ETPs. 3.2 It shall again be the responsibility of the Main Line Operator (MLO) or the Carrier / Custodian authorized by the concerned MLO to produce a copy of the Manual Transhipment Permit before the Customs Officer (Appraiser / Superintendent) posted at the Gateway Port, who shall upon approving Allowed for Shipment manually, endorse the hard copy of the TP accordingly, which shall be returned to the Kolkata / Haldia Port and the concerned Customs Officer posted at the Terminals / Docks (Kolkata / Haldia) entrusted with job of maintaining / record-keeping of the Continuity Bonds (Para 3 above refers) shall manually re-credit the bond amount, upon being satisfied that the respective consignment have been handed over to the proper authorities at the Gateway Port. 3.3 The said arrangement in respect of manual Shipping Bills processed at SEZ shall be followed / continued till the NSDL is interfaced / connectivity established with the ICES. 4. The Public Notice No. 10/2019 dated 30.01.2019 is therefore modified to the above extent. 5. Difficulty, if any faced in implementation of this Public Notice may be brought to the notice of the Jurisdictional Deputy/Assistant Commissioner of Customs.
