No. 263/18/89-CX.8] Government of India Ministry of Finance (Department of Revenue) Central Board of Excise Customs, New Delhi Subject : General permission under Rule 57F(1)(ii) - Filing of Pricelist/Classification list - Regarding. It has been represented that an assessee is required to file a pricelist and a classification list with respect to inputs cleared as such under Rule 57F(1)(ii), in spite of the fact that general permission to clear inputs has been given under the aforesaid rule. This would not give any real relief to assessees. The matter has been examined by the Board. In this connection attention is invited to Board's letter F. No. 267/109/88-CX.8, dated 22-12-1988 (Circular No. 67/88) under which instructions regarding redetermination of value/rate of duty of inputs cleared as such under Rule 57F(1)(ii) have been issued. In continuation thereof it has been decided that in cases where the inputs are sold at the same price at which they are received or where they are transferred to any other factory other than by sale, the assessee can be exempted from filing pricelist under Rule 173C(II). In cases where the assessee intends to sell the goods at a price higher than the original price of the goods, filing of the price list, will be mandatory. However classification list will be required to be filed in all such cases where the inputs are cleared as such. The above instructions may be brought to the notice of the Trade and field formations. Receipt of this letter may please be acknowledged.
