Ltd. ) - reg The area admeasuring 94668.65 SQM of Container Freight Station located at Village-Khopta, Post-Koproli, Taluka-Uran, Disst. Raigad, Maharashtra was declared as Customs Area under section 8 of the Customs Act, 1962 vide Notification No. 09/2012 dated 30.08.2012 and M/s Transindia Logistics Park Pvt. Ltd. was declared as Custodian of the Notified Area vide CFS Notification No. 11/2012 dated 05.09.2012 for Two (02) years under section 45(1) and 141(2) of the Customs Act, 1962. 2. Mis Transindia Logistics Park Pvt. Ltd. sold their Container Freight Station to M/s All Cargo Logistics Ltd. pursuant to business transfer agreement dated 11.08.2016 and subsequently M/s All Cargo Logistics Ltd was declared as Custodian of the Notified area vide Notification No. 13/2016 dated 22.12.2016 for the period of Five(05) years. 3 An additional area admeasuring 7,500 SQM was notified as a Customs Area under section 8(a) 8(b) of the Customs Act 1962 vide Notification No. 14/2017 dated 09.01.2017 issued vide F. No. S/5-Gen/47/2011 CFS M. Cell. Thus the total area of the CFS M/s All Cargo Logistics Ltd. notified under section 8 of Customs Act 1962 is 1,02,168.66 SQM. 4. Vide Public Notice No. 103/2021 dated 22.12.2021, CFS M/s All Cargo Logistics Ltd in respect of its Notified area 1,02,168.66 SQM, has been appointed as Custodian for the period of 30 days from 23.12.2021 and further vide Public Notice No. 04./2021 dated 21.01.2022 for a period of 10 Years from 22.01.2022. 5. All Cargo Logistics Limited has demerged into two entities i.e. All Cargo Terminals Limited and Trans India Logistics Park Limited vide Order of NCLT dated 05.01.2023 in C.P.(C.A.A.)/2015/MB/2022. All the business activities like operation of Container Freight Station (CFS) and all other related ancillary allied activities shall be carried out by Allcargo Terminals Limited (CIN: U60300MH2019PLC320697). 6. Now, in exercise of the powers conferred on me under Section 45(1) and 141 (2) of the Customs Act, 1962, |, D. S. Garbyal, Commissioner of Customs, General, Mumbai Zone- Il, Nhava Sheva hereby appoint M/s All Cargo Terminals Limited to be the Custodian of the Imported goods received at the Container Freight Station of M/s All Cargo Logistics Ltd. until these are cleared for home consumption or are warehoused or are transhipped in accordance with the provisions of Chapter VIII of the Customs Act, 1962 for the entire Customs Area of 1,02,168.66 SQM. Similarly, M/s All Cargo Terminals Limited will also be the Custodian of the Export cargo brought into said Container Freight Station for examination and stuffing till their exportation through Jawaharlal Nehru Port. OC: Scanned with OKEN Scanner 7. Further, in exercise of the powers conferred on me under Regulation 10 of the Handling of Cargo in Customs Areas Regulations, 2009 , |, D. S. Garbyal, Commissioner of Customs, General, JNCH hereby approve All Cargo Terminals Limited as a Customs Cargo Services Provider for the above mentioned Container Freight Station subject to the following conditions; (i) The Custodian M/s All Cargo Terminals Limited approved as Customs Cargo Services Provider for the said CFS shall abide by all the provisions of the Customs Act, 1962 and the rules under the Handling of Cargo in Customs Areas Regulations, 2009 and other regulations, notifications, orders issued there under. (ii) The duration of appointment of M/s All Cargo Terminals Limited as Custodian and as the Customs Cargo Service Provider shall remain valid for a period of Five (05) years from the date of issue of this Public Notice unless otherwise suspended/renewal/ cancelled prior to the expiry of the said period. (iii) The Commissioner of Customs (General), JNCH shall have the Right to review the approval as Customs Cargo Services Provider before the completion of ten year/5 years for failure to comply with any of the Regulations of the Handling of Cargo in Customs Areas Regulations, 2009 or as per the directions of the Government of India.
