Ltd. reg CFS M/s Take Care Logistics Park (India) Private Limited located at Palaspe, Panvel-Goa Highway, Tal Panvel, Dist-Raigad-410206 was appointed as Custodian under Section 45 of the Customs Act, 1962 vide Notification No. 30/2015 dated 14.07.2015 for the CFS. The area was declared as Customs Area under Section 8 of Customs Act, 1962 vide Notification No. 29/2019 dated 14.07.2015. Further, M/s Take Care Logistics Park (India) Private Limited has been appointed as Custodian and Customs Cargo Service Provider for five (05) years vide Notification No. 08/2017 dated 08.06.2017 in respect of its Notified area of 36,456 SQM which was later extended vide Public Notice No. 27/2022 dated 06.06.2022 upto 20.09.2028. 2. The Hon'ble National Company Law Tribunal, Mumbai vide order dated 11.07.2023 in Company Petition No. CP(CAA) /70/MB-IV/2023 in CA(CAA)/241/MB/2022 has sanctioned the scheme of Amalgamation of M/s Take Care Logistics Park (India) Pvt. Ltd. with M / s Hind Terminals Pvt. Ltd. under Section 232 read with Section 230 of the Companies Act, 2013 and rules framed there under. Hence, all the business activities like operation of Container Freight Station (CFS) and all other related ancillary allied activities shall be carried out by M/s Hind Terminals Pvt. Ltd. Accordingly, M/s Hind Terminals Pvt. Ltd. applied for change of the name of CFS/CCSP from M/s Take Care Logistics Park (India) Pvt. Ltd. to M/s Hind Terminals Pvt. Ltd. 3. Now, in exercise of the powers conferred on me under Section 45(1) and 141 (2) of the Customs Act, 1962, I, D.S. Garbyal, Commissioner of Customs (General), Mumbai Zone- II, Nhava Sheva hereby approve the name change of M/s Take Care Logistics Park (India) Pvt. Ltd. to M/s Hind Terminals Pvt. Ltd. and appoint M/s Hind Terminals Pvt. Ltd. to be the Custodian of the Imported goods received at the Container Freight Station of M/s Hind Terminals Pvt. Ltd. until these are cleared for home consumption or are warehoused or are transhipped in accordance with the provisions of Chapter VIII of the Customs Act, 1962 for the entire Customs Area of 36,456 SOM. Similarly, of M/s Hind Terminals Pvt. Ltd. will also be the Custodian of the Export cargo brought into said Container Freight Station for examination and stuffing till their exportation through Jawaharlal Nehru Port. 3. Further, in exercise of the powers conferred on me under Regulation 10 of the Handling of Cargo in Customs Areas Regulations, 2009 , I, D.S. Garbyal, Commissioner of Customs (General), JNCH hereby approve of M/s Hind Terminals Pvt. Ltd. as a Customs Cargo Services Provider for the above mentioned Container Freight Station subject to the following conditions; (i) The Custodian M/s Hind Terminals Pvt. Ltd. approved as Customs Cargo Services Provider for the said CFS shall abide by all the provisions of the Customs Act, 1962 and the rules under the Handling of Cargo in Customs Areas Regulations, 2009 and other regulations, notifications, orders issued there under. (ii) The duration of appointment of M /s Hind Terminals Pvt. Ltd. as Custodian and as the Customs Cargo Service Provider shall remain valid up to 20.09.2028 from the date of issue of this Public Notice provided the validity of the AEO-LO status of the CFS extended. If the validity of AEO status granted to the CFS is withdrawn prior to the 25.08.2024 or is not extended beyond 25.08.2024 the validity shall be valid for a period of five (05) year from the date of issue of this Public Notice. (iii) The waiver from execution of Bank Guarantee has been given in terms of . regulation 5(3) of HCCAR, 2009 as the CFS has been accredited with AEO- LO status with validity till 25.08.2024. If the validity of AEO status granted to the CFS is withdrawn prior to the 25.08.2024 or is not extended beyond 25.08.2024, the CFS shall execute bank guarantee for the amount, as determined, w.e.f. date of expiry of validity of AEO status. (iv) M/s Hind Terminals Pvt. Ltd. will submit the copy of MPCB consent after transfer of name in the name of M/s Hind Terminals Pvt. Ltd. At present the MPCB consent is in the name of M/s Take Care Logistics Park (India) Pvt. Ltd. and the MPCB Consent is yet to be amended in the name of M/s Hind Terminals Pvt. Ltd. by MPCB. (v) The Commissioner of Customs (General), JNCH shall have the Right to review the approval as Customs Cargo Services Provider before 20.09.2028 for failure to comply with any of the Regulations of the Handling of Cargo in Customs Areas Regulations, 2009 or as per the directions of the Government of India.
