DIN- 20230872MP0000333BE0 Date: 11-08-2023 PUBLIC NOTICE NO. 13/2023 Kind attention of the Airlines/Customs House Agents/Customs Brokers/Members of Trade is invited to the Notification No. 03/2023 issued by the Principal Commissioner of Customs, Airport Air Cargo Complex, Bengaluru, wherein M/s Bangalore International Airport Limitedhas been appointed as Customs Cargo Service Provider and Custodian at Air Cargo Terminal, Kempegowda International Airport, Devanahalli, Bengaluru under the Handling of Cargo in Customs Areas Regulations, 2009, and Section 45(1) of the Customs Act, 1962 in the Customs Area with effect from 24.05.2023. Further, due to said changes, various representations have been received from trade seeking clarification regarding international transshipment of cargo arriving from a foreign destination and proceeding to a foreign destination via an airport in India from one flight to another. The procedure needs to be streamlined in order to ensure efficient Cargo Transfer facility in consonance with CBIC Circular No.06/2007-Cus dated 22.01.2007, further amended by the CBIC Circular No.08/2011-Cus dated 28.01.2011. The matter has been examined and procedure will be as below: 2. Detailed Procedure for International-to-International Transshipment: A. The carrier/airlines shall give prior intimation regarding the goods to be brought to ACC Bengaluru for transshipment to foreign destinations, including the details of the onward flight through which the goods shall be transshipped to the final destination. B. The carrier/airlines is required to file application for transshipment of cargo and the Cargo Transfer Manifest (CTM) prepared by the airlines shall be treated as an application for transshipment. Such transshipment should be approved by the Proper officer of Customs. (Asst. /Dy. Commr.) C. The Custodian/ the Customs Cargo Service Providers (CCSPs)i.e. M/s Menzies M/s WFS shall provide a separate and dedicated area for segregation and storage of such consignments meant for transshipment and Scanner should be installed in the area for faster clearance. D. Upon arrival of cargo, the transshipment cargo meant destination abroad shall be segregated in the Custodian s premises and stored in the designated area of the CCSPs. E. Once the transshipment is approved by the proper officer (Superintendent Transshipment), the cargo shall be escorted to the outbound flight by the Transshipment officer on duty.No physical examination needs to be conducted except on specific Intelligence. F. Only marks numbers of the Cargo need to be certified and such cargo may be exported with other regular export cargo. The provisions of Circular no 06/2007-Cus dated 22.01.2007as amended by theCBIC Circular No.08/2011-Cus dated 28.01.2011are to be complied with. G. The movement of Goods between one warehouse to another warehouse shall be done with proper debit credit in the physical Bond register which has to be simultaneously maintained by the respective warehouses as per Notification No. 68/2016- Customs (N.T) dated 14.05.2016. 3. With respect to the above said procedure, the approved Custodian/Customs Cargo Service Provider shall be responsible for: (i) Proper receipt, handling, and storage of goods meant for international transshipment after their receipt and fulfill all conditions of Regulation 5(1) of Handling of Cargo in Customs Areas Regulations, 2009. (ii) Penalty in case of loss of any such goods meant for international transshipment after their receipt and before their intended purpose. (iii) Maintaining proper record of all international transshipped goods including those disposed of under Section 48 or otherwise. (iv) Payment of duty/penalty on any such transshipment goods that are pilfered or lost after entry in customs area. (v) Keeping the International Cargo meant for transshipment (Foreign to Foreign) in a separately demarcated area. (vi) Ensuring that no prohibited/illegal goods are brought into the Customs Area in the name of International transshipment. 4. Difficulties, if any, in the implementation of these instructions may be brought to the notice of the Additional Commissioner(Transshipment), AP ACC Commissionerate.
