No. GEN/EPC/MISC/112/2024-POL DATED: 16.05.2024 Public Notice No. 06 / 2024 Subject : Receipt of e-BRC for the exports made during the period of 01.04.2014 to 30.06.2023, as per RBI BRC Module - reg. ****** Attention of all Exporters, Customs Brokers and Members of Trade etc. is invited to the Board Circular No. 5/2009-Cus dated 02.02.2009 wherein it was mandated to use the online new RBI BRC Module for monitoring of realization of export proceeds in BRC for all the Shipping Bills with LEO dates from 01.04.2014 onwards, with regard to DG Systems letter F. No.IV(35)/58/20 12-Sys/2473 dated 18/20.11.2015 and JS Drawback's F.No.609/59/2012-DBK dated 03.06.2015 and instruction dated 27.11.2015. 2. The RBI BRC Module (RBI MIS Reports), which was launched on 26.06.2014, is applicable for Shipping Bills with Let Export Order (LEO) dates from O1.04.2014 onwards. 3. As seen from ICES, a large number of IEC holders e-BRCs are not available/updated in ICES. Hence, the IEC holders are advised to follow up with their Authorized Dealer Banks for updating the export proceeds realization details in the respective bank's EDPMS system so that the data is transferred to Customs EDI i.e. ICES for reconciliation. 4. In case, the updation has not done by Authorized Dealer Banks or updation done by bank has not been reflecting in/reconciled with ICES, the IEC holders can submit the details of (i) realization received certificates from their Authorized Dealers (e-BRC) or (ii) half yearly negative statements in prescribed format from Authorized Dealer banks or (iii) certificates provided by Authorized dealer banks in respect of the shipments which remain outstanding beyond the prescribed time limit, including the extended time, if any, allowed by Authorized Dealer bank/RBI; or otherwise, to the Assistant Commissioner, BRC Section. This will help this office in monitoring the realisation of export proceeds. 5. Further, it is also seen from the ICES that a large number of BRC alerts have been pending. Details of the same, as fetched from system, is enclosed to this notice. Hence the concerned IEC Holders are advised to approach BRC Section, Custom House, Tuticorin for removal of alert as mentioned in the enclosure to this public notice. 6. However, even after removal of alert, the Customs does not preclude from conducting random checks and also from taking action for any misrepresentation, mis-declaration and default detected subsequently as per the Customs Act, and other allied acts for time being in force. In case of exporter having IEC alert, approval from concerned Deputy/Assistant Commissioner is mandatory before clearing cargo. 7. Difficulty, if any, faced by IEC holders, may be brought to the notice of the Assistant Commissioner of Customs, BRC Cell, Custom House, Tuticorin (Nodal Officer).
