Quarterly Returns by Registered Dealers. - Central Excise - 32/2006Extract OFFICE OF THE COMMISSIONER OF CENTRAL EXCISE AHMEDABAD-II TRADE NOTICE NO. 32/2006 CENVAT NO 4/2006 Dated : July 4, 2006 Sub : Trade Notice on Quarterly Returns by Registered Dealers. There are large number of dealers who are registered with the Central Excise Department under Rule 9 of the Central Excise Rules, 2002, but it has been noticed that some of these registered dealers are not following the Central Excise Procedures properly as they are not filing the Quarterly Returns regularly or/ and have not filed returns for the last four quarters., (2) Rule 9 (8) of Cenvat Credit Rules 2004, lays down the statutory requirement to file quarterly return. Its states "A first stage dealer or a second stage dealer, as the case may be, shall submit within 15 days from the close of each quarter of a year to the Superintendent of Central Excise, a return in the form specified, by notification by the Board." Hence, all the registered dealers in the jurisdiction of the Commissionerate are hereby directed to file all the pending returns on or before 20th July, 2006. In case of such failure, action for cancellation of registration and imposition of penalty will be initiated as per law. (3) Further, all registered dealers are requested to file their returns within the time limit prescribed as per frequency prescribed in Rule 9 (8) of the Cenvat Credit Rules,2004 , failing which action as per law will be taken. (4) The registered dealers are further requested to note that they have to file 'NIL' report, even if they do not transect any business during the quarter. (5) All Trade Associations/ Chamber or Commerce and the Members of the RAC/PGC are requested to bring this to the notice of their members/constituents.
