Revised schedule of fee for standing counsels of IT dept. - Income Tax - 1828/1989

INSTRUCTION NO. 1828/1989 Dated: September 13, 1989 I am directed to refer to boards instruction No.1806 dated 3-2-89 regarding revised schedule of fee payable to standing counsels of I.T. Department before various High Courts and to inform you that the said instructions stand amended so as to insert the following clause after para 3.5 of Annexure-II to the schedule : 3.5 A. If the hearing of the case is adjourned for other reasons the fee for the day shall be Rs.250 only. No adjournment fee will be payable in respect of connected cases when the same is paid for one of the cases. The adjournment fee will be payable in respect of connected cases when the same is paid for one of the case. The adjournment fee will be exclusive of the hearing fees payable for the case. It is clarified that the counsel shall be entitled for only 3 non-hearings in the entire case. 2. The above clause was inadvertently omitted in the earlier instructions which was issued after Ministry of Law and Justice's concurrence vide their Disp.No.3837/88 dated 17.10.88.
