Denim fabrics or fabrics of yarns of different colours of 3 or 4 thread twill etc. - Amendment to Notification No. 40/95-C.E.

In exercise of the powers conferred by sub-section (1) of section 5A of the Central Excises and Salt Act, 1944 (1 of 1944) read with sub-section (3) of section 3 of the Additional Duties of Excise (Goods of Special Importance) Act, 1957 (58 of 1957), the Central Government being satisfied that it is necessary in the public interest so to do, hereby makes the following further amendment in the notification of the Government of India in the Ministry of Finance (Department of Revenue) No. 40/95-Central Excises, dated the 16th March, 1995, namely : -

In the said notification, after the table the Explanation shall be numbered as Explanation I and after Explanation I as so renumbered, the following Explanation shall be added, namely :

Explanation II. - The exemption contained in this notification shall not apply to fabrics commonly known as "denim fabrics" or fabrics of yarns of different colours, of 3-thread or 4-thread twill, including broken twill, warp faced, the warp yarns of which are of one and the same colour and the weft yarns of which are unbleached, bleached, dyed grey or coloured a lighter shade of the colour of the warp yarns.
