Bulk drugs - Effective rates of duty Notification No. 8/95-C.E. Dated 9-2-1995 In exercise of the powers conferred by sub-section (1) of section 5A of the Central Excises and Salt Act, 1944 (1 of 1944), the Central Government, being satisfied that it is necessary in the public interest so to do, hereby exempts goods specified in column (2) of the Table hereto annexed and falling within Chapter 28, 29 or 30 of the Schedule to the Central Excise Tariff Act, 1985 (5 of 1986), as the case may be, from that portion of the duty of excise leviable thereon which is specified in the said Schedule as is in excess of the amount calculated at the rate specified in the corresponding entry in column (3) of the said Table, subject to the conditions, if any, specified in the corresponding entry in column (4) of the said Table. No. 1 above; and (2) Para Nitrochloro- benzene (PNCB) (ii) where such use is elsewhere than in the factory of production of the said bulk drugs, the procedure set out in Chapter X of the Central Excise Rules, 1944, is followed. Bulk drugs other than those specified at S. No. 1 above 10%— Explanation - For the purposes of this notification, (i) "bulk drug" means any pharmaceutical, chemical, biological or plant product including its salts, esters, stereo-isomers and derivatives, conforming to pharmacopoeial or other standards specified in the Second Schedule to the Drugs and Cosmetics Act, 1940 (23 of 1940), and which is used as such or as an ingredient in any formulation : (ii) "formulation" means medicaments processed out of or containing one or more bulk drugs, with or without the use of any pharmaceutical aids (such as diluent, disintegrating agent, moistening agent, lubricant, buffering agent, stabiliser or preserver) which are therapeutically inert and do not interfere with therapeutical or prophylactic activity of the drugs, for internal or external use, or in the diagnosis, treatment, mitigation or prevention of disease in human beings or animals, but shall not include any substance to which the provisions of the Drugs and Cosmetics Act, 1940 (23 of 1940) do not apply.
