Exemption to textured yarn from basic duty made out of non-textured yarn imported under Duty Exemption Scheme meant for export

In exercise of the powers conferred by sub-section (1) of section 5A of the Central Excises and Salt Act, 1944 (1 of 1944), the Central Government, being satisfied that it is necessary in the public interest so to do, hereby exempts Textured Yarn falling under heading No. 54.03 of the Schedule to the Central Excise Tariff Act, 1985 (5 of 1986), and manufactured out of filament yarn (other than textured) imported under the Duty Exemption Scheme of the Export and Import Policy, 1 April 1992 - 31 March 1997, from the whole of the duty of excise leviable thereon which is specified in the said Schedule :

Provided that the exemption contained in this notification shall be applicable only if it is proved to the satisfaction of the Assistant Collector of Central Excise that such textured yarn is to be exported or used in the manufacture of any other goods which are to be exported out of India.
