Notification No. 269/90-Cus. Dated 1-11-1990 In exercise of the powers conferred by sub-section (1) of section 25 of the Customs Act, 1962 (52 of 1962), the Central Government being satisfied that it is necessary in the public interest so to do, hereby makes the following further amendments in the notification of the Government of India in the Ministry of Finance (Department of Revenue) No. 237/78-Cus., dated the 18th December, 1978, namely :- In the said notification, for the provisos, the following proviso shall be substituted, namely :- "Provided that - (a) the passport or export certificate relating to such horses, mares, colts or fillies, as the case may be, shall be endorsed by the proper officer to the effect that the said imported horses, mares, colts or fillies shall not be used or allowed to be used for racing purposes before the expiry of five years from the date of their importation; (b) the importer shall give an undertaking in writing to the Assistant Collector of Customs at the time of clearance that the importer shall furnish within a period of four months from the date of clearance or within such extended period as the Assistant Collector of Customs may allow, a certificate from the Stud Book Authority of India to the effect that entries relating to the said imported horses, mares, colts or fillies, as the case may be , have been made in the Stud Book of India; (c) the importer executes a bond in such form and for such sum, as the Assistant Collector of Customs may, having regard to the circumstances of the case, specify, binding himself to pay that sum in the event of horses, mares, colts or fillies, as the case may be, being put to use or sold for any purpose other than breeding, before the expiry of five years from the date of their importation."
