Dated 16-6-1986 In exercise of the powers conferred by sub-section (1) of section 25 of the Customs Act, 1962 (52 of 1962), the Central Government being satisfied that it is necessary in the public interest so to do, hereby exempts the parts [other than parts containing thermionic valves or transistors or other semi-conductor devices or light emitting diodes electric thermo-circuits or capacitors (other than paper capacitors)] of the goods specified in the Table hereto annexed and falling within Chapter 84 or Chapter 85 of the First Schedule to the Customs Tariff Act, 1975 (51 of 1975), when imported into India, (i) for the purpose of maintenance of computers and computer systems by such maintenance agencies of computers as are registered in this behalf with the Department of Electronics of the Government of India, and (ii) for the purpose of maintenance of computer systems by indigenous manufacturers of computer systems if it is proved to the satisfaction of the Assistant Collector of Customs to be so required for such purpose, from (a) so much of that portion of the duty of customs leviable thereon which is specified in the said First Schedule, as is in excess of the amount calculated at the rate of 50 per cent ad valorem ; and(b) the whole of the additional duty leviable thereon under Section 3 of the said Customs Tariff Act, subject to the following, conditions, namely : (i) an officer not lower in rank than a Joint Director in the Department of Electronics of the Government of India is satisfied that the goods in question are required for the purpose of specified above and certifies to this effect and recommends grant of above exemption; (ii) the importer shall, by the execution of a bond in such form and for such sum as may be specified by the Assistant Collector of Customs, bind himself to pay, on demand, in respect of such goods as are not proved to the satisfaction of the Assistant Collector of Customs to have been used for the aforesaid purpose, an amount equal to the difference between the duty leviable on such goods but for the exemption contained herein and that already paid at the time of importation TABLE Sl.
