Competition Appellate Tribunal (Salaries and Allowances and other terms and conditions of service of the Chairperson and other Members) Second Amendment Rules, 2009 - Amendment in Rules 4, 7, 10, 11, 13, 14 and 19 - G.S.R. 827(E) - Competition LawExtract Competition Appellate Tribunal (Salaries and Allowances and other terms and conditions of service of the Chairperson and other Members) Second Amendment Rules, 2009 - Amendment in Rules 4, 7, 10, 11, 13, 14 and 19 Notification No. G.S.R. 827(E) Dated 16-11-2009 In exercise of the powers conferred by clause (mc) of sub-section (2) of section 63 read with sub-section (1) of section 53G of the Competition Act 2002 (12 of 2003) , the Central Government hereby makes the following rules to further amend the Competition Appellate Tribunal (Salaries and Allowances and other terms and conditions of service of the Chairperson and other Members) Rules, 2009, namely: - 1. Short title and commencement . - (1) These rules may be called the Competition Appellate Tribunal (Salaries and Allowances and other terms and conditions of service of the Chairperson and other Members) Second Amendment Rules, 2009. (2) They shall come into force on the date of their publication in the Official Gazette. 2. In the Competition Appellate Tribunal (Salaries and Allowances and other terms and conditions of service of the Chairperson and other Members) Rules, 2009,- (i) in rule 4, for the words In case of serving Judge , the words In case of serving or retired Judge of the Supreme Court or serving or retired Chief Justice of a High Court shall be substituted; (ii) in rule 7, in, sub-rule 1 in clause (i),- (a) for the words A serving Judge of the Supreme Court or Chief Justice of a High Court , the words A serving or retired Judge of the Supreme Court or Chief Justice of a High Court shall be substituted; (b) proviso shall be omitted. (iii) in rule 10,- (a) for the words serving Judge , the words serving or retired Judge of the Supreme Court or Chief Justice of a High Court shall be substituted; (b) the words The retired Judge of the Supreme Court or the Chief Justice of India appointed as the Chairperson and shall be omitted; (iv) in rule 11, for the words The Chairperson , the words When a serving or retired Judge of the Supreme Court or Chief Justice of a High Court is appointed as Chairperson, he shall be entitled to Leave Travel Concession as is admissible to a serving Judge of the Supreme Court or Chief Justice of a High Court, as the case may be; shall be substituted; (v) in rule 13, for the words A Member would be eligible for a fixed reimbursement for the use and maintenance of his personal car for transportation between residence and office as laid down by Department of Personnel and Training from time to time , the words A Member shall be entitled for conveyance facilities as are admissible to Group 'A' officer of the Central Government or State Government drawing an equivalent pay shall be substituted; (vi) for rule 14, the following shall be substituted, namely:- 14. Accommodation.- The Chairperson and Members of the Appellate Tribunal shall be entitled for General Pool Residential Accommodation. If they do not avail the accommodation facilities, they shall be entitled for House Rent Allowance as is admissible to Group 'A' officer of the Central Government or State Government drawing an equivalent pay. . (vii) in rule 19, for the words shall be referred by the Appellate Tribunal to the Central Government for its decision , the words shall be determined by the rules and orders for the time being applicable to a serving Judge or Chief Justice of a High Court as the case may be in the case of Chairperson and officer drawing an equivalent pay in the Central Government in case of Member shall be substituted.
