Subject:- Sick Industrial Companies (Special Provisions) Act, 1985 - Section 13(1) - Procedure for filing interlocutory applications before Appellate Authority In exercise of the powers conferred by sub-section (1) of section 13 of the Sick Industrial Companies (Special Provisions) Act, 1985 (1 of 1986), and in continuation of the Gazette Notification No. 22, dated 17-6-1996, the Appellate Authority for Industrial and Financial Reconstruction prescribes the following procedure for filling of interlocutory applications before the Authority: (a) The interlocutory application, in triplicate, should be filed, duly signed by the applicant or attorney, supported by an affidavit and also with the proof of advance notice to the respondents. (b) All applications should be: (i) Indexed. (ii) Accompanied by documents relied upon by the applicant, and (iii) Accompanied by power of attorney/vakalatnama, wherever necessary. (c) All applications should indicate the names and addresses of the applicants and the respondents. (d) In the case of impleadment petitions, advance notice will also have to be given to the person/persons proposed to be impleaded. (e) The applications shall be taken up by the authority for consideration at the next date of hearing of the appeal/proceedings for early hearing are obtained through Mention . The above procedure shall come into force with effect from the date of its publication in the Official Gazette.
