In excess of the authorized quantity and unregistered growers have also resorted to unauthorized FCV tobacco cultivation in the State of Andhra Pradesh . MINISTRY OF COMMERCE AND INDUSTRY (Department of Commerce) NOTIFICATION New Delhi , the 1st July, 2008 S.O. 1596(E).— Whereas, the Central Government has been informed by the Tobacco Board that a large number of registered growers have cultivated Flue Cured Virginia Tobacco (hereinafter referred to as FCV tobacco) in excess of the authorized quantity and unregistered growers have also resorted to unauthorized FCV tobacco cultivation in the State of Andhra Pradesh, causing a mismatch between the demand and supply position; And, whereas, the Central Government is satisfied that it is necessary and expedient to authorize Tobacco Board to allow the purchase of FCV tobacco and considers it appropriate to dispose of the excess FCV tobacco crop of the registered growers and the FCV Tobacco crop of the unregistered growers at the designated auction platforms of the Tobacco Board in the State of Andhra Pradesh; Now, therefore, in exercise of the powers conferred by Section 20A, read with clause (g) of sub-section (2) of Section 8 of the Tobacco Board Act, 1975 (4 of 1975), the Central Government hereby authorizes the Tobacco Board to admit, from the date of publication of this notification in the Official Gazette and up to 15th September, 2008, the registered traders and dealers of the Tobacco Board to purchase, at its auction platforms in the State of Andhra Pradesh, the excess FCV tobacco produced by the registered growers and FCV tobacco produced by unregistered growers in the State of Andhra Pradesh, subject to the following conditions, namely (a) The penalty of Rs.1 per kg. as an extra fee and 5% of the proceeds of the sale as service charges shall be contributed to the Tobacco Fund by every registered grower for the excess FCV tobacco and unregistered grower for the FCV tobacco produced by them for 2007-08 and 2008-09 crop seasons. If such excess/unauthorized cultivation does not stop, the matter will be reviewed after two years and the penalty and service charges will be restored to the level of the crop season of the year 2006-07.
