Exemption u/s 35AC - Central Government had specified "The Himalayan Rural Health Care Scheme (Hospital on Wheels)" by Indian Spinal Injuries Centre, Sector C, Vasant Kunj, New Delhi 110 070, as an eligible project or the scheme Notification No. S. O. 1847(E) dated 25th July, 2008 . Whereas by notification of the Government of India, in the Ministry of Finance (Department of Revenue) number S. O. 1822(E) dated the 26th October, 2006 issued under sub-section (1) read with clause (b) of the Explanation to section 35AC of the Income-tax Act, 1961 (43 of 1961), the Central Government had specified at serial number 10 "The Himalayan Rural Health Care Scheme (Hospital on Wheels)" by Indian Spinal Injuries Centre, Sector C, Vasant Kunj, New Delhi 110 070, as an eligible project or the scheme for a period of three years beginning with the financial year 2006-07; And, whereas, the National Committee for Promotion of Social and Economic Welfare, on the basis of the request of the applicant trust to withdraw the approval as the donation could not be collected by the trust during the approved period and hence recommended under sub-section (5) of the said section for withdrawal of approval granted under section 35AC of the Income-tax Act, 1961 (43 of 1961) , in so far as it specifies the trust and the project or scheme at serial number 10; Now, therefore, in exercise of the powers conferred by sub-sections (4) and (5) of section 35AC of the Income-tax Act, 1961 , the Central Government hereby withdraws the approval granted to Indian Spinal Injuries Centre, Sector C, Vasant Kunj, New Delhi 110 070 and withdraws the notification of the Government of India, in the Ministry of Finance (Department of Revenue), number S. O. 1822(E) dated the 26th October, 2006', published in the Gazette of India, Extraordinary, Part II, section 3(ii) dated the 26th October, 2006, in so far as it relates to the project or the scheme "The Himalayan Rural Health Care Scheme (Hospital on Wheels)" being carried out by Indian Spinal Injuries Centre, Sector C, Vasant Kunj, New Delhi 110 070, mentioned at serial number 10 in the aforesaid notification and makes the following amendment in the said notification, namely :— In the said notification, the serial number 10 relating to the project or the scheme "The Himalayan Rural Health Care Scheme (Hospital on Wheels)" being carried out by Indian Spinal Injuries Centre, Sector C, Vasant Kunj, New Delhi 110 070 and the entries relating thereto shall be omitted and the certificate furnished under clause (a) of sub-section (2) of section 35AC of the Income-tax Act, 1961 , shall not be taken into consideration while calculating the tax of the income under the Income-tax Act, 1961 .
