It is seen that the allegation made against the appellant is very grave and it is based on the investigation carried out by the Revenue Intelligence and the matter has been referred to CBI and the CBI is seized of the matter. It is the grievance of the appellants that when the matter is still seized before the CBI, the Commissioner ought to have waited for the outcome of the said investigation and then should have proceeded to adjudicate this matter. It is stated by the Additional Commissioner in the para wise comments that the adjudicating authority has passed the order strictly in accordance with the provisions of Customs Law after observing the Principles of Natural Justice.
