On first check, it was observed that the goods would not fall under CTH 5911 90 90 as claimed by the importers. Pending test report from the Textile Committee, the goods were assessed under the above mentioned heading. The Textile Committee opined that the outer material was of "non-woven textiles-polyester 100%" and inner material was of "Polyolefin 100%" and the material as a whole could be considered as " non-woven textiles" (Geotextiles). Based on this report, the goods were assessed under CTH 3917 32 90 and duty was levied thereon which was paid by the assessees 'under protest' on 27-11-2006. The Commissioner (Appeals) upheld the classification under Chapter 39; however, he held that the goods could not be considered either as tubes or pipes or hoses in order to be classifiable under CTH 3917 32 90, but were articles of "Polyolefin" classified under CTH 3926 90 80. However, when two or more headings each refer to part only of the materials or substances contained in mixed or composite goods or to part only of the items in a set put up for retail sale, those headings are to be regarded as equally specific in relation to those goods, even if one of them gives a more complete or precise description of the goods. (b) Mixtures, composite goods consisting of different materials or made up of different components, and goods put up in sets for retail sale, which cannot be classified by reference to (a), shall be classified as if they consisted of the material or component which gives them their essential character, insofar as this criterion is applicable. (c) When goods cannot be classified by reference to (a) or (b), they shall be classified under the heading which occurs last in numerical order among those which equally merit consideration". 10. Rule 3(a) is not applicable as no heading provides for the more specific description of the goods and hence Rule 3(b) is attracted.
