We find from the arguments of both the sides as well as the reasons recorded, which do not indicate that there was any violation on the part of the assessee to disclose fully and truly all material facts necessary for the assessment of the assessee made u/s. 143(3) of the Act. We find that the Assessing Officer while framing original assessment u/s. 143(3) of the Act vide order dated 28.3.2005 definitely considered the facts and circumstances as well as the issue of applicability of explanation to section 73 of the Act.
