2007 (2) TMI 387 - AT - Customs

The Appellate Tribunal CESTAT, Mumbai overturned a penalty of Rs. 1,00,000 imposed on an employee of a Customs House Agent for aiding and abetting fraudulent export. The Tribunal found that the employee's casual approach in accepting export documents without proper verification was not sufficient to prove knowledge of the fraudulent export, thus setting aside the penalty under Section 114(iii) of the Customs Act.
