The suspension was done without issuing a show-cause notice or providing an opportunity to be heard. The reasons for suspension included alleged violations such as involvement in the export of red sanders to Hong Kong, failure to comply with export license conditions, and not following the procedure for incorporating license/CITES certificate details in the Shipping Bill. The appellants contended that the suspension was unjust as they had necessary permissions and clearances for the exports. The Tribunal found the reasons for suspension unsupported by facts and unsustainable, emphasizing that the Commissioner of Customs, Chennai lacked jurisdiction to suspend the license issued by the Commissioner of Customs at Vishakapattinam. Jurisdiction of Commissioner of Customs: The Tribunal analyzed Regulation 9 of the CHALR 2004 and observed that the license was issued by the Commissioner of Customs at Vishakapattinam, and the CHA had given intimation to the Chennai Commissioner to operate within his jurisdiction. The Chennai Commissioner had the authority to withdraw permission in accordance with law and natural justice but chose to suspend the license instead, an action deemed to be without jurisdiction. The Tribunal set aside the impugned order and allowed the appeal, disposing of the stay application as well. Separate Judgment: No separate judgment was delivered by the judges in this case.
