Stay Petition for Waiver of Pre-Deposit: The stay petition was filed by the applicant seeking waiver of the amount confirmed by the adjudicating authority. Despite the absence of any representation from the applicant, the Tribunal proceeded with the matter due to its 2008 nature. After hearing the learned DR and reviewing the records, the Tribunal observed that the appeal itself could be disposed of at that stage. Thus, after granting the waiver, the Tribunal decided to take up the appeal for disposal. Dismissal of Appeal on Time Limitation Ground: Upon perusal of the records, it was noted that the appeal was dismissed by the Commissioner (Appeals) citing 'time limitation'. The Commissioner found that the appeal was filed well after the three-month appeal period had expired. Although the appellant had provided a medical certificate stating hospitalization for backache as a reason for the delay, the Commissioner deemed it insufficient. The Tribunal, however, disagreed with the Commissioner's decision, stating that hospitalization should not be considered a ruse for delaying the appeal filing. The Tribunal found that the appeal was filed within the extended period of three months, which the Commissioner had the power to condone. Consequently, the Tribunal set aside the Commissioner's order, remanding the matter for reconsideration and directing a fresh decision on the issue. In conclusion, the Tribunal granted the waiver in the stay petition and disposed of both the stay petition and the appeal accordingly, emphasizing the need for a sympathetic consideration of the circumstances leading to the delay in filing the appeal.
