The Central Board of Excise and Customs remanded a case for de novo adjudication due to failure to produce recovery witnesses for cross-examination, which violated principles of natural justice. The order imposing a personal penalty on Bishan Chand Gupta was set aside as he was not given an opportunity to show cause.
