Analysis:
The High Court of KERALA dealt with references under section 27(1) of the Wealth-tax Act, 1957, for the assessment years 1970-71 and 1971-72. In the current case, the High Court reiterated the principles established in the previous judgment regarding the valuation of the asset, i.e., the decree obtained by the assessee. The court emphasized that the valuation was based on a thorough consideration of the realities of the situation and all relevant factors. Despite the assessee not being represented during the proceedings, the court proceeded to answer the questions in the affirmative against the assessee and in favor of the Revenue. The court acknowledged the assistance provided by an advocate present in the courtroom and directed the judgment to be forwarded to the Income-tax Appellate Tribunal, Cochin Bench, as required by law.
