The Supreme Court allowed the appeal, set aside the High Court judgment, and remanded the case for decision on two points not previously decided. The High Court had set aside the dismissal order due to the non-supply of the inquiry report to the respondent, but the Supreme Court held that the law in question applied prospectively and the respondent could not benefit from it retroactively.
