2009 (2) TMI 223 - HC - Customs

The High Court of Judicature at Bombay, with judges Ranjana Desai and J.P. Devadhar, issued a judgment in 2009 regarding a widow, the petitioner, whose husband was intercepted by Customs Officers in 1994 carrying 40 gold bars. After various legal proceedings, the Joint Secretary to the Government of India allowed the gold to be released upon payment of a redemption fine and other fees. The petitioner claimed the gold was sold in 1995 and sought an equivalent quantity or compensation. The court found the petitioner's delay in seeking implementation of the order unacceptable, and dismissed the petition. The Assistant Commissioner of Customs explained that due to falling gold prices, the government decided to sell the gold. The court concluded that the petitioner failed to present a case for relief and dismissed the petition.
