Summary

The Appellate Tribunal CESTAT, Bangalore allowed the stay application filed by the applicants for the waiver of pre-deposit of duty amounting to Rs. 30,491 and stay of the recovery proceedings. The applicants procured photocopy machines under exemption for use in their EOU plant and bonded them in their warehouse. The Tribunal found a prima facie case in favor of the party and granted the stay application.
