Summary

The Appellate Tribunal CESTAT, New Delhi, heard both sides and waived the requirement for pre-deposit of penalty since the appellant had already paid the duty demand. The recovery of penalty is stayed until the appeal is disposed of. The Revenue authorities are directed to release the goods detained during the pendency of the stay application. The matter is scheduled for a hearing on 7-6-2005.
