1996 (10) TMI 167 - AT - Central Excise

The appellants manufacture Fadomin tablets classified under 3003.10. The dispute is whether the product is entitled to exemption under Notification No. 29/88. The product contains pyrimathemine and sulpha-doxine, but only pyrimathemine is listed in the First Schedule to the Drugs (Prices) Control Order, 1987. The benefit of the Notification is denied as sulpha-doxine is not specified in the First Schedule. The appeal is rejected, confirming the denial of exemption.
