Rule 120 - Transmission of records upon transfer of proceeding. - Company Court Rules, 1959Extract Transmission of records upon transfer of proceeding. 120. (1) Where an order is made transferring the winding-up proceedings in a High Court to another Court, the Registrar of the High Court shall, without delay, transmit the records of the proceedings together with a certified copy of the order of transfer to the Court to which the proceedings are transferred. (2) Where the High Court makes an order withdrawing to its own file the winding-up proceedings in a District Court, the Registrar of the High Court shall forthwith forward a certified copy of the order to the said District Court, and that Court shall, on receipt of the order, despatch without delay the records of the proceedings to the High Court. (3) Where the High Court makes an order transferring the winding-up proceedings in a District Court to another District Court, the Registrar of the High Court shall forthwith forward a certified copy of the order to each of the said District Courts; and the Court whose proceedings are transferred shall, on receipt of the order, despatch without delay the records of the proceedings to the District Court to which they are transferred.
