9. Terms and condition of engagement of experts and professionals. (1) The expert and professionals on having accepted the offer of engagement, shall enter into a contract, also having the confidentiality clause, with the Secretary, acting on behalf of the Commission, detailing the terms and conditions of engagement, before being assigned any work. (2) The terms and conditions of engagement may be modified, in a specific case, where the Commission deems it necessary. (3) Without prejudice and in addition to the legal remedies available to the Commission, the breach of agreement executed under sub-regulation (1) by or on behalf of any 2 [ Experts and Young Professionals ] shall be considered a sufficient ground for termination of the engagement made under contract and may further debar such 2 [ Experts and Young Professionals ] from future engagement by the Commission. 3 [ (4) Confidentiality and Secrecy: (i) Experts and Young Professionals will be governed by the Indian Official Secret Act, 1923 and shall not disclose any information/data that they may gather by virtue of being Experts or Young Professional in the Competition Commission of India to any person who is not authorised in this regard during or after period of their engagement as Experts or Young Professional in the Competition Commission of India. (ii) Selected candidates shall provide integrity certificates from 2 references known to them. (iii) A self-undertaking shall be provided by the candidate to the effect that he/she has no criminal record or criminal case in any court is pending against him/her. ] ************** NOTES:- 1.
