Article 9 - Shipping - Kenya (Old - Effective upto 29-08-2017)

Article 9 : Shipping 1. Profits derived by an enterprise of a ContractingState from the operation of ships in international traffic may be taxed in both Contracting States according to the law of each ContractingState : PROVIDED that where such an enterprise derives profits from such operation in the other ContractingState : (a) such profits shall be deemed to be an amount not exceeding five per cent. of the full amount received by the enterprise on account of the carriage of passengers or freight embarked in that other State : (b) the tax chargeable in that other State shall be reduced by an amount equal to fifty per cent thereof.
