Subject:- Foreign Companies - Filing of documents with Registrar - Failure to file registration of charges within prescribed period Under the provisions of section 600, read with section 597(2), a foreign company has to file the document relating to the particulars of shares within 21 days (now 30 days) of the date of the creation of the charge with the Registrar of Companies, New Delhi, as well as with the Registrar of Companies of the State in which the principal place of business of the company is situated. Hence, ordinarily, in cases in which the document concerned was not filed with any of these Registrars within the prescribed period, the company should be advised to apply to the court (now Company Law Board) under section 141 for necessary relief.
